Photography Studio Rental Contract Overview


Explains the contractual agreement between the Client and the Photographer/Owner.

THIS AGREEMENT is made between the Client (“Referred to as Client”) and Dwan Miller (“Referred to as Dwan Miller Photography, LLC”).


OVERVIEW: Dwan Miller Photography's Studio is the Owner's personal studio that he rents out to other creative photographers or videographers for their photoshoots/video sessions. This studio has a client lounge, small kids play area, the photography studio space and access to a bathroom. This space is not handicap accessible.


CONTRACT DETAILS: The following agreement is between DWAN MILLER PHOTOGRAPHY, LLC, who may be referred to as the "Owner" and the client who may be referred to as the "Client". This agreement constitutes a request for photography studio rental services, including but not limited too; the taking of professional photographs and or capturing of professional videography as agreed to by both the Owner and Client. 


BOOKING / DEPOSIT: Clients must self book to request a studio date/time. It’s recommended to book immediately to avoid dates/times being confirmed by others (First Book/First Serve). After you have requested your preferred date, the Owner will review your request and make a decision if the studio is available. If the studio is available your session will be approve, you will be sent the rental contract to sign sign and then you must pay the nonrefundable deposit fee (50% of the final due price). The deposit fee is due the day upon the booking and the final balance is due the day of prior to occupying the rental space. The deposit fee can be paid by several touch-less payment options (CashApp, PayPal, Venmo, Zelle, ApplePay or I can send an invoice). LOCATION, ENTRANCE and PARKING OPTIONS: The Studio address is 327 Poyntz Ave, Suite 201, 2nd floor, Manhattan, KS 66502. The studio is located on the 2nd floor of the building downtown Manhattan, Kansas; right beside (to the left of the store) “Celebrations of the Hearts” and right above the store “Rooted”. We are also across the street from the restaurant “Tallgrass Taphouse”. The door to enter, on the street level, will have the Logo “Dwan Miller Photography” on the glass door. Parking may be limited on Poyntz Avenue and you may have to park on 4th street or in the big parking lot behind AJ Pizza. If you do park there just let me know and I can come down and let you in the back alleyway entrance. 


THINGS TO TAKE INTO CONSIDERATION: Be sure to factor any clean up, and tear downs into your booking time. The Client may come 15 min early to set up. The Owner will take care of handling all paper backdrop set ups and tear downs. The Client may contact the Owner to add more time to your booking if it's available. Please let the Owner know if any additional backdrop color(s) at least 24 hours prior to your session. Additional colors can be added to your rental for $20. 


SERVICES: Owner will have studio set up and ready at agreed upon start time. Owner will take care of handling all backdrop paper set up and tear downs. One backdrop color is included in your rental. Client must specify of any, backdrop color(s) at least 24 hours before session. Client will have access to all studio chairs, stools, and a posing box. Client will also have access to all V-flats, soft boxes, light stands, reflectors, and furniture.


COOPERATION: The parties agree to maintain a open line of communication via e-mail, text, and call if any issues arise before, during, or after rental.


STUDIO POLICY and DIRECTIVES: The Client agrees to comply with all studio rules below:


1. COOPERATION: The Client is responsible for both setting up and dismantling the rented space. Any time spent on setup or teardown that extends beyond the rental period will be billed as additional rented time. If you are still in studio beyond your scheduled time, you will be charged by the 1/2 hour ($37.50). This means if your rental ends at 10am you and your party must be out the door at 10am. 


2. TARDINESS: Please do not arrive more than 15 mins early. If you are late, your session will still end on time. The rental period commences at the specified time and ends as scheduled. Late arrival by the Client will not extend the rental period. Additional time required by the Client will be charged at the studio's hourly rate.


3. STUDIO RULES: 


- Music is to be kept at reasonable levels and appropriate language to not offend others. We do have an adjacent businesses located near our space and want to remain respectful and courteous.

- All paper backdrop handling must be done by studio owner please notify when ready to switch colors

- Studio must be cleaned, items put away, and put back in there original position by the end of the rental period.

- You must be vacated by the end of the rental period time. If you are still in studio beyond your scheduled time, you will be charged by the 1/2 hour ($37.50) to the card on file. This means if your rental ends at 10am you and your party must be out the door at 10am.

-NO fire

-NO glitter, cake bombs, confetti, and smoke bombs

-NO smoking whatsoever is allowed in the building

-NO pets allowed without prior consent

-NO strobe lights

-NO Illegal, dangerous, or negligent activities are strictly prohibited. Any violation may result in the immediate termination of the rental, and the authorities may be notified if illegal activities are observed.

-NO kids allowed in the studio unless they are a part of the shoot, and must be accompanied at all times in studio.


4. CONDUCT: This is public building and we maintain a professional environment here. Client shall be solely responsible for the conduct and welfare of all persons accompanying client while at studio. Client agrees that Owner will be present at all times. If the Owner observes or otherwise becomes aware of dangerous, pornographic, illegal or negligent practices or activities, the Owner reserves the right to stop the shoot and may require Client and party to leave immediately. The authorities will be alerted to any illegal actives witnessed by Owner. In such case no refunds will be given for unused time.


5. MINORS: Client is solely responsible for verifying that all clients subjects are of legal age or accompanied by a parent or legal guardian. Owner has no responsibility to determine or verity the age of participants in the Clients actives but reserves the right to demand proof of parental consent. Owner is not liable in the case of any invalid ID or any other form of age verification.


6. DAMAGE: Client is solely responsible for any damage to Owners property, furniture, or equipment that occurs during the time Client or his party occupies the Premises. Damages will be charged at full replacement or repair cost to the client.


7. BACKDROPS: All paper backdrops handling must be done by studio manager. Please let us know on the intake from what time you'd like us come back to switch colors. If you can hear the paper rustling you're too close to backdrop. Any damage done to seamless paper backdrops will result in a charge of $5 per foot. Do not touch or sit against the paper backdrop your body oil will stain the paper, and crinkle it! Damage examples; tears, stains, dirt footprints, water damage etc.


8. PROPS: The Client is allowed to use visibly displayed studio props. Unauthorized access to closed storage areas is prohibited. The Client is responsible for the proper placement of props after use. Additional props brought by the Client must be removed after the rental. Studio must be cleaned, items put away, and put back in there original position by the end of the rental period.


9. LIABILITY: Client assume liability for injury to self and any person(s) they invite to the booked session, Owner will not be held accountable. While reasonable efforts are made to maintain a safe environment, Dwan Miller Photography, LLC shall not be held liable for any incidents or damages occurring during the Client's occupancy. Owner is not liable for acts out of its control that affect the shoot, such as building equipment failures, power outages, the weather, acts of God, illness, or emergencies.


CANCELLATION, RESCHEDULING & REFUND POLICY: Dwan Miller Photography, LLC does not offer refund of the deposit. If you need to reschedule your session, please do so at least 24 hours prior to your scheduled booking and your deposit be counted towards the rescheduling. Failure to reschedule prior to 24 hours of your rental will result in you having to pay another nonrefundable deposit to schedule another rental date/time. If you cancel your session, you deposit doesn’t go towards your next rental request. The availability for rescheduling will be subject to the Owner's discretion. Please plan ahead with your clients & customers and be sure to arrive for your scheduled booking. Clients are only allowed to request a total of 2 request to reschedule their original appointment session. On the third request another deposit fee will be required. 


RAIN OR SHINE POLICY: If there is a storm or snow, we are running unless the roads are dangerous. We do however take the safety of our guests very seriously. If weather becomes excessively dangerous, we will reschedule on a case by case bases. Please pay attention to the weather, plan ahead for traffic, and road conditions. 


YOUR PRIVACY AND OUR SECURITY: We value your privacy and security. While we utilize security cameras for management, security, and damage control, rest assured that we respect your space and utilize surveillance responsibly. Kindly inform your guests that security cameras are in use during their visit. (Women owned and operated. Cameras are only checked when something has been found damaged, to see if you're still in space after session time has ended, or have received suspicious complaint from building.)


MERGER: This document constitutes the complete agreement between Dwan Miller Photography, LLC and the Renter/Client, superseding all prior and contemporaneous agreements. No modifications or alterations to this agreement shall be valid unless made in writing and signed by all parties involved. Any partial waiver of this agreement shall not constitute a waiver of the whole contract.
